1. Acceptance of terms

By accessing this website (https://cuegain.com) or submitting the DJ waitlist form, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use this site or submit the waitlist form. You may withdraw your consent and request deletion of your data at any time by emailing info@cuegain.com.

2. Service description

CueGain is currently a pre-launch product. The only service offered through this website is a waitlist signup form for DJs interested in early access to the CueGain platform, which is planned for private beta launch in Summer 2026.

Submitting the waitlist form does not create a binding contract for the provision of the CueGain platform. It registers your interest and consent to be contacted about the beta launch.

3. Eligibility

The waitlist is intended for professional or aspiring DJs aged 16 or older. By submitting the form, you represent that you are at least 16 years of age. If you are between 16 and 18, you confirm that you have the consent of a parent or legal guardian.

4. Use of the waitlist

By submitting the waitlist form, you consent to CueGain contacting you via the email address you provide, solely for the purposes of:

• Informing you about beta access availability and launch dates.
• Providing onboarding information for the private beta.
• Communicating material changes to the service or these terms.

You may unsubscribe and request deletion of your data at any time by emailing info@cuegain.com. Your data rights are detailed in our Privacy Policy.

5. Accuracy of information

You agree to provide accurate and complete information when submitting the waitlist form. You are responsible for updating your information if it changes. We reserve the right to remove submissions that are fraudulent, automated, or contain manifestly false information.

6. Intellectual property

All content on this website, including but not limited to the CueGain wordmark, branding, design, text, graphics, and source code, is the property of CueGain or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of this site without our prior written permission.

7. Disclaimers and forward-looking statements

The CueGain platform is not yet launched. All statements on this website regarding features, timelines, pricing, payout structures, or partnerships are forward-looking and aspirational. They do not constitute a contractual commitment, offer, or guarantee. The final terms of the CueGain platform will be communicated separately during beta onboarding and governed by a separate platform agreement.

Waitlist submission does not guarantee beta access. We reserve the right to determine the order, scope, and availability of beta invitations at our discretion.

8. No warranty

This website and the waitlist service are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be available continuously, securely, or free of errors.

9. Limitation of liability

To the fullest extent permitted by applicable law, CueGain shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of this website or the waitlist service.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation, or any mandatory consumer protection rights under EU law.

10. Force majeure

We shall not be liable for any failure or delay in performance of our obligations under these terms resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, pandemics, or other force majeure events.

11. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of the Republic of Finland, without regard to conflict of law principles. Any dispute arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the Helsinki District Court (Helsingin käräjäoikeus), unless otherwise required by mandatory consumer protection legislation of your country of residence.

If you are a consumer habitually resident in the EU, you retain the protection of the mandatory provisions of the consumer protection laws of your Member State of residence, in accordance with Regulation (EC) No 593/2008 (Rome I), Article 6(2).

12. Dispute resolution

If you are a consumer in the European Union, you may refer any unresolved dispute to the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Alternatively, you may contact the Finnish Consumer Disputes Board (Kuluttajariitalautakunta) at kuluttajariita.fi. We are committed to resolving disputes amicably wherever possible.

13. Changes to these terms

We may update these Terms of Service from time to time, including when the CueGain platform launches or when our service changes materially. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of this website after changes are posted constitutes acceptance of the revised terms. For material changes affecting your rights, we will provide prominent notice on this website.

14. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that achieves, to the extent possible, the original purpose and economic effect.

15. Entire agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and CueGain regarding your use of this website and the waitlist service. They supersede all prior or contemporaneous communications, whether electronic, oral, or written.
